Exclusive Hiring Services Agreement

These terms and conditions apply to a Renter who order’s online, in person, by email or over the telephone.

The Hirer is responsible for ensuring that their delivery/collection instructions and arrangements are consistent with parking restrictions. Classic Crockery reserves the right to pass on to the hirer the cost of any fines incurred due to delivery/collection instructions that neglect or ignore parking restrictions.

The hirer is fully responsible for the equipment and for insuring the equipment if necessary, from the time of acceptance until returned to our premises. No insurance is provided by Classic Crockery.

Rental Period

The normal rental period for all products and accessories is 2 days up to a maximum period that may not normally exceed 30 days. Any extension to the rental period must be agreed and specified in the new rental agreement, extra charges may apply. Unauthorised extensions to the rental period will be charged at the current rates plus a daily R100 penalty.

Exclusive Hiring Services agrees to rent crockery and accessories to the Renter for the period stated in the rental agreement. The rented goods shall at all times remain the property of Exclusive Hiring Services. The Renter is responsible for the rented goods during the rental period that commences from the time the goods are collected by the Renter. The hire period finishes when the goods are returned by the Renter.

Receiving Goods

When the goods are collected by the Renter, the Renter shall inspect the goods and sign the delivery note. In the event of any missing items or damage, the Renter shall note this on the delivery note at the time of collection or notify us before the items are used. If the Renter fails to do this, the goods will be deemed to have been delivered in a clean and undamaged condition. If no one is available to check the items, again the items will be deemed to have been delivered in a clean and undamaged condition.

Returning Goods

When Renter deliver the rented goods, they should be properly packed in the protective packaging, crates or cages they were delivered in..

Waiting Time

We like the Renter to collect and deliver at the agreed time.

Wash Up Service

All goods supplied by Exclusive Hiring Services are clean and ready to use. If the Renter opted to wash used goods themselves and the goods have not been cleaned to a satisfactory level we reserve the right to charge 15% of the Rental fee after we have notified you by email or phone.

Cutlery and silverware must be hand washed or rinsed after use even if washing service agreed in advance. Under no circumstances should scourers or abrasives be used on any hired equipment.

Table linen must not be returned or stored damp or wet. Damage resulting from mildew or other stains and burn marks that will not respond to laundering will be charged at full replacement cost.

Terms of Payment

When a Renter places an order, Exclusive Hiring Services ask for a non-refundable deposit of 50% of the Rental fee within 21 days of the event, if an order is placed within 7 days of the event Exclusive Hiring Services would ask for 100% of the Rental fee which is not refundable. If the Renter cancels the order for whatever reason the damage deposit and washing up fee will be refunded but not the 50% of the Rental fee if you cancel within 21 days and none of the Rental fee if you cancel within 7 days. No dates or goods are considered confirmed until a deposit has been paid.

The 10% of the total amount for the refundable damage deposit is charged at the time of hire, this will be returned once goods have been returned and checked for any damage or loss. The Renter will be informed within a maximum of 4 working days if there is any damage, missing or substituted items. Missing and or damage to the rented goods will be charged at the prices and deducted accordingly from the Renters damage deposit.

On demand, if the Renter still owes money, Exclusive Hiring Services, have the right to take legal action against the Renter.


Classic Crockery shall have no Liability to the Renter if, without just cause, any monies due in respect of the rented goods have not been paid in full by the due date for payment.

Nothing in this Contract shall exclude or limit the Liability of the Supplier for death or personal injury due to the Supplier’s negligence nor exclude or limit any other type of Liability which it is not permitted to exclude or limit as a matter of law.

Any defective rented goods must be returned to the Supplier for inspection if requested by the Supplier before the Supplier will have any Liability for defective hire goods.


For the purpose of any proceedings herein the PARTIES hereby consent to the jurisdiction of the Magistrate’s Court notwithstanding that such proceedings are otherwise beyond this jurisdiction. This clause shall be deemed to constitute the required written consent conferring jurisdiction upon the said Court pursuant to Section 45 of the Magistrate’s Court Act of 1944, as amended. Notwithstanding the aforegoing, Exclusive Hiring Services shall have the right at the sole discretion to institute proceedings in any other competent Court which might have jurisdiction.
